These Terms and Conditions ("Terms") govern your access to and use of Mindivate, including the mobile app, related websites, content, subscriptions, and services.
By downloading, installing, creating an account, subscribing to, or using Mindivate, you agree to these Terms. If you do not agree, do not use Mindivate.

Mindivate is a wellness app designed to support gradual behavior change and self-reflection. Features may include:
Features may vary by platform, country, app version, account status, subscription status, and availability of third-party services.
Mindivate is not a medical device, healthcare provider, emergency service, therapist, psychologist, doctor, or clinical mental health service.
Mindivate does not provide diagnosis, medical advice, therapy, treatment, crisis intervention, or emergency support. The app is for general wellness, education, self-help, and reflection.
The LSAS feature is a self-report assessment tool. It is not a diagnosis. Scores may be useful for reflection, but only a qualified professional can assess your individual situation.
Lumi is an AI coach, not a human professional. Lumi's responses may be inaccurate, incomplete, or inappropriate for your circumstances.
If you are in danger, may harm yourself or someone else, or need urgent help, contact emergency services, a crisis line, a qualified healthcare professional, or someone you trust immediately.
You must be at least 13 years old to use Mindivate.
If you are under the age of majority where you live, you may use Mindivate only with permission from a parent or legal guardian. The parent or guardian is responsible for the minor's use of Mindivate.
You may not use Mindivate if you are legally barred from using the app or if we previously suspended or terminated your account for violating these Terms.

You are responsible for activity under your account, except where caused by our breach of these Terms or applicable law.
Your use of Mindivate is also governed by the Privacy Policy. The Privacy Policy explains what personal data is collected, how it is used, and what choices and rights you may have.
Some Mindivate features may require a paid subscription, such as expanded exercise access, custom challenges, Lumi AI coach, or LSAS history.
Available plans, pricing, trial availability, and included features may change over time and may vary by country, store, platform, promotions, and app version.
Subscriptions purchased in the mobile app are billed by Apple App Store or Google Play. Your purchase is subject to the store's payment terms, subscription terms, cancellation rules, and refund policies.
We do not process your card details directly.
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period, or as otherwise stated by Apple or Google.
Your account may be charged for renewal within 24 hours before the end of the current period, depending on store rules.
If a free trial is offered, it will convert to a paid subscription unless you cancel before the trial ends. Any unused portion of a free trial may be forfeited if you purchase a subscription, subject to store rules.
You can cancel through your Apple App Store or Google Play subscription settings. We cannot cancel a subscription on your behalf when it is managed by Apple or Google. Cancellation normally takes effect at the end of the current billing period, and you usually retain access to paid features until the subscription expires.
Deleting the app or deleting your Mindivate account does not automatically cancel a subscription managed by Apple or Google.
Refunds are handled by Apple or Google according to their policies. We generally cannot issue refunds directly for purchases made through Apple App Store or Google Play. Where mandatory local consumer protection laws apply, such as applicable EU withdrawal or refund rights, those rights are not affected.
Subscription prices may change. Where required, the relevant app store will notify you or request consent before a price change applies.
You agree not to:
We may suspend or terminate access if we reasonably believe you violated these Terms or created risk for users, the app, or third-party services.
You may enter or create content in Mindivate, such as mood notes, custom challenges, support messages, and Lumi chat messages ("User Content").
You retain ownership of your User Content. You grant Mindivate a limited, worldwide, non-exclusive license to host, store, process, display, transmit, and use your User Content only as needed to provide, secure, maintain, and improve Mindivate and as described in the Privacy Policy.
For Lumi, you also authorize us to send the relevant message and context to our AI service provider to generate responses.
You are responsible for your User Content. Do not enter content that you do not have the right to provide, including sensitive information about other people.
Lumi uses generative AI. AI output may be wrong, incomplete, delayed, biased, unsafe, or unsuitable for your situation.
You agree that:
We may limit, disable, or change Lumi at any time for safety, reliability, cost control, compliance, or product reasons.
Mindivate, including the app, software, design, text, exercises, challenge library, illustrations, Lumi character, graphics, branding, and other content, is owned by or licensed to Lumos Ignite and is protected by intellectual property laws.
Subject to these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable, non-sublicensable license to use Mindivate for your own personal, non-commercial use.
You may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, or create derivative works from Mindivate except where allowed by law.
Mindivate depends on third-party services, including Apple, Google, Firebase, RevenueCat, Expo, and external support resources.
We are not responsible for third-party services, websites, payment systems, policies, outages, content, or practices. Your use of third-party services may be governed by their own terms and privacy policies.
Links to external resources, such as Findahelpline, are provided for convenience and support. We do not control those resources.
If you download Mindivate from Apple App Store or Google Play, your use is also subject to the applicable store terms.
For Apple App Store users:
For Google Play users, Google is not responsible for Mindivate except as stated in Google Play's own terms and policies.
We may update, modify, suspend, or discontinue Mindivate or any feature at any time. Updates may be delivered through the app stores or over-the-air update services.
We do not guarantee that Mindivate will always be available, uninterrupted, secure, error-free, or compatible with every device or operating system version.
Some features may depend on internet access, Firebase, Google AI services, RevenueCat, Apple, Google Play, Expo, or other providers.
We are not responsible for interruptions caused by events beyond our reasonable control, such as outages of third-party services, network failures, force majeure events, natural disasters, legal restrictions, or emergency maintenance.
You may stop using Mindivate at any time. You may delete your account in the app where available or contact info@lumosignite.com.
Deleting your account does not automatically cancel app store subscriptions. You must cancel subscriptions through Apple App Store or Google Play.
We may suspend or terminate access if:
After termination, provisions that by their nature should survive will survive, including intellectual property, disclaimers, limitation of liability, dispute terms, and payment obligations already incurred.
Mindivate is provided "as is" and "as available."
To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and reliability.
We do not guarantee that:
Nothing in these Terms limits rights that cannot be limited under applicable consumer law.
To the maximum extent permitted by law, Lumos Ignite and Mindivate will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, data, or business opportunity.
To the maximum extent permitted by law, our total liability for claims relating to Mindivate will not exceed the amount you paid for Mindivate in the 12 months before the event giving rise to the claim, or EUR 50 if you paid nothing.
Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for fraud, intentional misconduct, gross negligence where applicable, or death or personal injury caused by negligence where such limitation is prohibited.
If you use Mindivate on behalf of a business or organization, you agree to indemnify and hold Lumos Ignite harmless from claims, losses, liabilities, damages, costs, and expenses arising from your misuse of Mindivate, violation of these Terms, or violation of third-party rights.
This section applies only to the extent permitted by applicable law and does not limit mandatory consumer rights.
We may update these Terms from time to time. When we do, we will update the "Last updated" date.
For material changes, we may provide notice in the app or by other reasonable means. Continued use of Mindivate after updated Terms become effective means you accept the updated Terms.
If you do not agree to updated Terms, stop using Mindivate and cancel any subscription through the app store where you purchased it.
These Terms are governed by the laws of Sweden, without regard to conflict of law rules.
If you are a consumer in the EU/EEA, you may also benefit from mandatory consumer protections in your country of residence.
Before bringing a formal dispute, please contact us at info@lumosignite.com so we can try to resolve the issue.
Consumers in Sweden may be able to contact Allmanna reklamationsnamnden (ARN), the Swedish National Board for Consumer Disputes. ARN provides alternative dispute resolution for certain consumer disputes: https://www.arn.se
The European Commission's Online Dispute Resolution platform was discontinued in 2025. Consumers in the EU can find consumer redress information through relevant national consumer authorities and EU consumer redress resources.
If any part of these Terms is found invalid or unenforceable, the remaining parts will remain in effect. The invalid or unenforceable part will be interpreted or replaced to best accomplish its original purpose to the extent permitted by law.
These Terms, together with the Privacy Policy and any additional terms presented in the app or app store purchase flow, form the entire agreement between you and us regarding Mindivate.
